Before getting divorced or separated, you should consider whether the relationship has broken down beyond repair. Naturally, this will apply to almost everyone. Secondly, for a divorce or separation, one of the following formal legal facts needs to exist: adultery committed by the respondent, unreasonable behaviour exhibited by the respondent, desertion of the petitioner by the respondent for two years, a situation where the couple have been living apart for a period of two years or longer and mutually agree to a divorce.
Legal differences between divorce and separation
The main difference between separation and divorce is this: to get divorced, you must have been married for a period of 12 months or longer. There is no such requirement for judicial separation. Generally, the process of separation is quicker and easier; for separation only a decree of separation is required, whereas for a divorce a decree nisi and a decree absolute are needed. A decree nisi states that a divorce will be legally complete after a period of six weeks and one day. A decree absolute makes a divorce legally complete.
