The status of pre-nuptial agreements is, at present, dubious.  However, there is a general consensus of the courts that they will be acceptable where both parties have sought independent legal advice, fully disclosed their personal assets and no children have been born during the course of the marriage.  We can help you properly draft pre-nuptial agreements and make sure you are fully informed of the effect of any agreement made.

Child maintenance

In the majority of cases, parents will come to a private arrangement regarding child maintenance where there is a non-resident parent.  However, disputes can happen and where this is the case, the Child Support Agency will get in involved.  We can provide you with advice on how to make applications to the Agency for maintenance orders.

Child contact orders

Contact orders are only necessary where there is a dispute within a family following divorce or separation that cannot be settled out of court.  Any member of the family, including siblings and grandparents, can make an application and we can of course be assistance in making an application.  If you are a non-resident parent, you should be aware that non-payment of maintenance cannot prevent you from having contact with your child as contact and maintenance are two separate issues not congruent on each other.
