Mediation and Arbitration

Mediation is a way of resolving disputes by finding common ground between parties.  A neutral, independent person known as a mediator is used to find that common ground and where possible try and settle disputes out of court.  Any agreement reached can be made legally binding with the consent of both parties such that any failure to follow the agreement can result in further legal action for breach of contract.

Arbitration can be thought of as informal trial where an independent is appointed with the consent of both parties and asked to come to a decision on the case. Like mediation, any decision reached can be made legally binding with the consent of both parties.
